Common Questions about DWLR

 

Driving While License Revoked, or suspended, (DWLR) is a class three misdemeanor in North Carolina. This means that the charge is much more serious than your "typical" speeding citation. The charge is rather self-descriptive - it means that you've been cited driving in North Carolina without the privilege to do so. It is important to consult with an experienced traffic attorney before seeking to handle this type of charge.

When you receive an NOL charge, it regularly means that you have never had a license before. To remedy this, in most cases you simply need to obtain a license. An expired license charge means that you previously had a license, but it expired. To remedy this charge, in most cases you simply need to renew your license. The difference with a DWLR charge, however, is that at one point you had an active North Carolina driving privilege, but it was affirmatively taken away from you by the DMV due to some offense on your part.

There are several reasons why your license may be revoked, including:

1. Failing to handle a previous citation, known as “Failure to Appear”
2. Handling a citation but failing to pay your court costs, known as “Failure to Pay”
3. Receiving point-accumulating violations on your record, that total up to 12-points, in a three-year period
4. Receiving a high level speeding violation that causes a statutory suspension of your license
5. A change in your medical condition (i.e. an epilepsy diagnosis or worsening eyesight).


These are all potential instances that could suspend your license and where an officer could charge you with DWLR if you are driving.

An indefinite suspension means that your license will be suspended until there is an action taken on your part, such as handling an old traffic citation or paying off old outstanding court costs. Your license could also be indefinitely suspended due to a medical condition which requires you to visit a doctor and report back to the NC DMV regarding any health related concerns. A permanent revocation means that your license has been cancelled and cannot be reinstated without great effort. In order to get your license back, you will have to request approval from the DMV, pay any fines or penalties, and pass the driving test. Limited Driving Privileges (LDP) are an option for drivers facing permanent suspension. An LDP is not possible in the case of indefinite suspension where the driver has unresolved court cases or court fines.

There are two main types of DWLR charges.

The first, "DWLR - Not Impaired", can occur for many different reasons, such as failing to handle previous citations, failing to pay court costs, or receiving 12-points on your license in a 3-year period. This type of DWLR is a class three misdemeanor in NC. While a conviction for DWLR - Not Impaired would not normally result in jail time, it is still a serious offense that could benefit from the assistance of an attorney.

The second, "DWLR - Impaired", is related to driving after a prior Driving While Impaired charge or conviction. This is the more serious of the two types because it means you were driving during a period of license suspension for a prior DWI, whether pre- or post-trial. This DWLR is a class one misdemeanor in NC and carries a serious risk of jail time. If you've been charged with DWLR Impaired, it's vital that you call an attorney immediately.

When looking at a DWLR charge, you have to first take care of the reason why your license was suspended.
